The absolute owner of the content and photos is Nino Marcutti – further in the text the author. The ownership of the photos is not for sale, but the rights to use the content or photos are assigned according to the purchased license.

The customer can be a natural or legal person. The account is not transferable to another person. The person named during registration is responsible for the account of legal entities. False representations and giving other people’s names are expressly prohibited.

The user guarantees that the data is original and authentic. The user is obliged to keep the data and password safe and is responsible for the resulting damage. The content should be published with the specified source and author, e.g. ninomarcutti.com, i.e. where technically feasible, e.g. “© ninomarcutti / stock.ninomarcutti.com

The photographs you find on this website will not be found on other pages. All photos are exclusive. After use, the photos must be deleted within 30 days from the day of purchase, so that they do not become the subject of third-party copyright infringement.

Terms and rights are subject to change, which users are obliged to check in order to be familiar with the terms of use for mutual benefit. Rights to changes and additions to the rules are possible without special announcement and without responding to the consequences of changes to the contract.

1. NON-COMMERCIAL LICENSE FOR PERSONAL USE Allows one user exclusively as a natural person (companies excluded) to use the image on prints for personal use or gifts, personal website. Not for editorial, commercial or resale prints.
   • One user license worldwide
   • Up to 5000 prints
   • Printing – for personal prints or gifts such as canvas prints, greeting cards, posters, magnets, personal blog, etc. Photo wallpapers – (not for sale)
   • Electronic use – only for personal website unlimited (not editorial, business or commercial), mobile publications and app unlimited, web background
   • Not for editorial, commercial use, resale use or resale of prints
   • License duration up to 5 years.

2. EXTENDED EDITORIAL USE LICENSE
   It allows only one user (company or individual) to use the image once for:
   • Print – in magazines, newspapers, book covers, textbooks, educational materials, editorial and promotional projects
   • Electronic use – social media, blogs, mobile applications, web wallpapers, TV, e-book covers, online album or playlist covers, broadcast media or elements for mobile applications or video games
   • Circulation is limited to 100,000 copies.
   • Unlimited use of the web for the above activities
   • This license is not for commercial use, resale of prints, resale use
   • License duration up to 5 years.

3. COMMERCIAL USE LICENSE This license is required when the content represents the core value of the product or derivatives into a product intended for resale or other distribution.
   It contains everything contained in the licenses under points 1 and 2, and in addition allows one or more users within the same organization/company to use the content, as long as all users agree to be bound by the provisions of this contract, and that the client remains responsible for use by additional users in the same purpose.
   Allows the incorporation of content or derivatives into products intended for resale or other distribution (including when distributed for free) when the content represents the core value of the product.
   • Such products are, for example, posters, calendars, stationery, e-postcards and electronic products, powerpoint presentations, photo books, stickers, mugs, clothing, artwork, screensavers or wallpapers, templates for e.g. web pages turn- key, pre-formatted emails or newsletters, or blog or CMS themes).
   • The purchase of this license includes a free license for multiple users of the same organization.
   • Prints are limited to 500,000 copies.
   • Unlimited use of the web for the above activities
   • Duration up to 5 years

4. CLOUD LICENSE – enables the right of the customer to download the same content three times within a month without additional payment after purchasing the content. The customer needs to log in to his account and then he has the right to download the content. This option allows one or more users to share content, and it is related exclusively to the same project that is being worked on. Storing photos on other servers such as google drive, dropbox and others is not allowed.
5. MARKET STOP – a license that enables stopping the trading of content for a certain period in order to gain an advantage on the market.

LIMITATIONS
It is especially forbidden to sell, share, sublicense, transfer, copy in whole or in part or in any way any content from the stock.ninomarcutti.com page except for the license under which it was purchased. All content is purchased under a single unified license and must be used as such.
Failure to sign or incorrect signature of the author of the photos and the source of the photos is considered a violation of these terms and constitutes a violation of copyright in accordance with the Act on Copyright and Related Rights and is subject to sanctions.
Using a retracement photo in such a way as to create a new image in any technique is considered a copy of the image and is therefore not permitted under any license as it would infringe copyright.
Intervening in the content of the photo in any technique in such a way as to add or delete elements, the tonality of the image is not allowed under any license.
Content on social networks, use the content in an editorial way, commercially, in the press without stating the source and signature of the author.

The customer is responsible for the content he buys, where he archives it, who uses it and everything related to any further procedures that include copying to other media, computers of the same or another company.

sell or distribute the content or the work in which the content is placed, in such a way that the content is extracted, accessed or downloaded as a stand-alone file.

It is not allowed to download, extract the content as an independent file from a third person who is not authorized to do so.
The content may not be used in a pornographic, defamatory or other illegal manner, infringes the protection of trademarks, trademarks or trademarks or as part or all of a logo, trademark or trademark.
